The National Committee of the RMLA has been made aware of issues arising about the conduct of mediations and whether more flexibility should be enabled to allow or even encourage remote participation through video conferencing or other means so that the mediation process can be conducted efficiently in all cases.
The RMLA would like to hear from its members about their thoughts on this issue.
In particular, the RMLA would like to understand:
- Whether better flexibility around remote attendance at mediations is something that would be supported;
- If so, whether any specific guidelines should be implemented;
- What risks do any members foresee about enabling remote attendance at mediations; and
- Any other suggestions/thoughts on this topic.
The RMLA has indicated to the Chief Judge of the Environment Court that the RMLA will be canvasing the views of its members on this issue, and once the comments are received, the RMLA will be discussing them with the Environment Court to see whether it is feasible to prepare and adopt a practice note on this issue.
